Terms of Service

These terms govern your use of the BitrateCraft website. By reading or otherwise using the site, you accept them. If you do not accept them, please stop using the site.

1. What this site is

BitrateCraft is an independent editorial site. It publishes explanatory articles, comparisons, and reference notes about open-source video encoding and media tools, including material that discusses the HandBrake project. The site is informational. It does not host, operate, or distribute any program, and it is not a service that you sign in to.

2. Permitted use

You may read these pages, print them for your own reference, quote short passages with a credit and a link back, and link to any page from your own work. The following summary sets out what is allowed and what is not.

  1. Reading, printing, and storing pages for personal reference: allowed.
  2. Quoting a short extract with attribution and a link: allowed.
  3. Linking to a page from an article, lesson, or forum post: allowed.
  4. Republishing a whole article, or mirroring the site under another name: not allowed without written permission.
  5. Automated reading at a rate that degrades service for other visitors: not allowed.
  6. Probing the server, or reaching for areas that are not public: not allowed.

You may not copy the site wholesale, present it as your own, or use it to send unsolicited commercial messages. You may not remove or hide the disclaimer banner that the site places at the top of every page, because that banner tells readers what this site is and is not.

3. Editorial content and intellectual property

The articles, diagrams, and page design on this site are the work of the BitrateCraft editorial desk and are protected by copyright. The name BitrateCraft and the site's own marks belong to the desk. Quoting a short extract for comment, teaching, or review is welcome when the source is credited. Republishing a full article requires written permission from desk@bitratecraft.org.

4. Third-party names

Project and product names that appear in articles, including HandBrake and the names of codecs, containers, and operating systems, belong to their respective owners. They are used only to identify and describe the software being discussed. Their appearance does not suggest that any owner sponsors, endorses, or is connected with this site, and it does not grant you any right to use those names.

5. Editorial independence and no affiliation

BitrateCraft is not affiliated with, endorsed by, sponsored by, or otherwise connected to the HandBrake project, its maintainers, or any other project named on this site. Articles are written independently, on the basis of the desk's own reading, testing notes, and public documentation. No project has editorial control over what appears here, and no project reviews articles before they are published.

6. No software and no hosted service

This site provides words and diagrams only. It does not supply programs, does not host files, and does not operate any encoding service. When an article describes how to set up or configure a tool, the reader obtains that tool from its own project and is bound by that project's own terms and licence. The desk cannot answer questions about how a tool behaves on your machine beyond what the articles already say.

7. Accuracy, and no professional advice

Articles are written carefully, but they are general information rather than professional advice. Encoding behaviour depends on hardware, version, and settings, so results may differ from those described. Verify anything important against the primary documentation of the tool you use, and treat the articles here as a starting point rather than a final authority.

8. Limitation of liability

To the fullest extent permitted by law, the site and its editors are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the site or from reliance on anything published here. This includes lost time, lost data, and lost profits. Where the law does not allow a full exclusion, liability is limited to the smallest amount the law permits. Nothing in these terms limits liability that cannot lawfully be limited.

9. Availability, and changes to the site

The site is offered as it stands. Pages may be edited, moved, or retired, and the site may be unavailable at times for maintenance. These terms may be revised, and the version published here at the time of your visit is the one that applies to that visit.

10. Indemnity

If you use the site in a way that breaks these terms and that causes a claim against the desk, you agree to cover the reasonable costs of answering that claim.

11. Governing law

These terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law rules. Any dispute is brought in the state or federal courts sitting in Travis County, Texas.

12. Contact

Questions about these terms go to legal@bitratecraft.org, or by post to BitrateCraft Editorial Desk, 2610 Webberville Road, Suite 214, Austin, TX 78702, United States.
